1
Filing a takedown notice
To qualify as a valid notice under 17 U.S.C. § 512(c)(3), your submission must include every element below. Missing or ambiguous items may delay processing or cause the notice to be rejected.
1
Identify yourself Full legal name, postal address, telephone number, and an e-mail address at which we can reach you. Pseudonyms and throw-away addresses are not accepted.
2
Identify the work being infringed Describe the copyrighted work clearly. If the notice covers many works under the same ownership, a representative list is acceptable.
3
Identify the infringing material Provide the full URL(s) of every file on Up-4ever you want removed. Without specific URLs we cannot locate the content.
4
Good-faith statement An explicit statement that you have a good-faith belief the disputed use is not authorised by the copyright owner, its agent, or applicable law.
5
Accuracy statement — under penalty of perjury An explicit statement that the information in your notice is accurate and that you are either the copyright owner or authorised to act on the owner’s behalf.
6
Sign it A physical or electronic signature of the rights holder or its authorised representative.
2
How we respond
Once a valid notice arrives, we will:
Remove or disable access to the reported material within a reasonable timeframe.
Notify the user who uploaded the material so they have an opportunity to respond.
Retain a copy of the notice in our records to support our repeat-infringer policy.
Reply to the complainant to confirm the action taken, where contact details allow.
3
Counter-notification
If you believe your content was removed by mistake or misidentification, you may file a counter-notice with our agent at [email protected]. A valid counter-notice must contain:
Your full contact information.
Identification of the removed material and the URL it occupied before removal.
A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
Your consent to the jurisdiction of the courts where you reside, or — if you are outside the United States — the courts where Up-4ever is located.
Your physical or electronic signature.
We will forward your counter-notice to the original complainant. If they do not initiate court action within ten to fourteen business days, we may restore the file at our sole discretion.
4
Repeat-infringer policy
Accounts identified as repeat infringers are terminated in accordance with 17 U.S.C. § 512(i). Termination affects the user’s ability to upload, share, and earn on Up-4ever, including any pending payouts attributable to the infringing content.
